Bankruptcy Overview

Resolving Financial Issues for Arizona Clients

I am attorney Mark L. Lischwe, and I am here to help clients find the debt relief they need. I work closely with my clients to help them find the solution that is most appropriate for their situation. For some clients that means filing for bankruptcy, for others it means credit counseling or negotiating with creditors.

With 28 years of experience, I can help you create a solution that addresses your needs. I represent clients throughout the Phoenix, Arizona area, with three convenient office locations. Contact me online or call 602-252-7552 to schedule your free initial consultation with an experienced lawyer.

Frequently Asked Bankruptcy Questions

Although bankruptcy was designed to help people find financial stability, many people have negative ideas or misconceptions about bankruptcy. I take the time to answer my clients' questions and carefully explain every step of the process, including:

  • Am I a good candidate for bankruptcy?
  • Will I be able to keep my house? What about the car?
  • What debts can be discharged?
  • Is bankruptcy the best option for me?
  • Are there alternatives to bankruptcy?

Chapter 7 Bankruptcy

Chapter 7 bankruptcy is ideal for people who cannot afford their debt and do not think they will ever be able to pay it off. Also called liquidation bankruptcy, Chapter 7 bankruptcy discharges all qualifying debt. In exchange, some of your assets may be sold to raise money for your creditors.

Chapter 13 Bankruptcy

Chapter 13 bankruptcy is ideal for people who have fallen behind but think they will be able to repay it over time. Chapter 13 bankruptcy is also called reorganization bankruptcy because all your debts are consolidated. A payment plan is put together, and you must make monthly payments towards your debt for 3-5 years.

Home Foreclosure

If you are facing foreclosure, filling for Chapter 13 bankruptcy will stop the sale. I help clients understand the anti-deficiency statute and the implications is has on their situation. I also help clients figure out lasting solutions (such as loan modifications or lien stripping), so they can enjoy long-term financial stability.
